Abstract
The recent case of McArthur v Timberbush Tours Limited and ERS Syndicate Management Limited [2021] CSOH 75 will be of interest to all those engaged in fatal accident litigation. Not only does the case provide important guidance in relation to the assessment of transmissible solatium and non-patrimonial awards to various family members, but it also provides useful consideration of the defence of contributory negligence.
