Abstract
Considers prescription and limitation of actions in the context of historic abuse in light of the decision in K v Marist Bros (IH (2 Div)) concerning the approach to the Prescription and Limitation (Scotland) Act 1973 s.17 where a claimant alleging historic sexual abuse while at a Catholic boarding school was under a legal disability due to unsoundness of mind.
