Abstract
This, the first part of a two-part article, examines the background to McCulloch v Forth Valley Health Board (SC) that the professional practice test established in Hunter v Hanley (IH) was the correct legal test in determining the reasonable alternative treatment options that a doctor had a duty of care to inform a patient about.
